Respond to Defective Notice u/s 139(9), ITR filing, Filed Income Tax Return

Income tax department sends to the taxpayers an intimation when the department finds an error with the ITR filed. Failing to respond to the notice within the allotted time for notices under section 139(9) can result in your return being treated invalid.

After you file your ITR, ITD will process and cross-verify the details provided in ITR. The ITD compares the details provided by taxpayer with the information that is available with them. If they find any discrepancies or mistakes or any information is missing in ITR then they will treat your ITR as Defective Return. They will then issue a Defective Return notice u/s 139(9). Note: You must revise your return addressing the defects within 15 days from the date of receipt of intimation.

How to respond notice from income tax dept issued u/s 139(9):

Step 1 Logon to 'e-Filing' Portal www.incometaxindiaefiling.gov.in
Step 2 Go to the 'e-File' menu located at upper-left side of the page ⇒ Click 'e-File in response to Notice u/s 139(9)'
Step 3 Click the hyperlink 'Submit' (To respond notice u/s 139(9))
Step 4 Choose the any one of the following option from column 'Do you agree with defect?'

• YES
• NO(If you disagree with the defect then enter your remarks under column 'Assessee Remark')

If you select YES, Upload the correct XML ⇒ Click Submit

Step 5 To view the submitted response, Click 'View' link under Response column ⇒ Click 'Transaction ID' to know the detailed of response submitted.
